These Terms of Use (“Terms”) govern your use of the DayEcho mobile application, website, and related services (“Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 13 years old (or 16 where applicable by law) to use the Services. By using DayEcho, you confirm you have the legal capacity to enter into these Terms.

2. User Accounts

You are responsible for maintaining the confidentiality of your login credentials.

You agree to provide accurate and complete information when creating an account.

You must notify us immediately of any unauthorized use of your account.

3. Use of the Services

You agree not to:

Misuse the Services or use them for unlawful purposes.

Upload content that is illegal, abusive, offensive, or infringes on intellectual property rights.

Attempt to access, reverse-engineer, or interfere with the Services.

We may suspend or terminate your account for violations.

4. Content Ownership

You retain ownership of all content you create and upload to the Services.

By using the Services, you grant us a non-exclusive, worldwide, royalty-free license to process your content solely for providing the Services (e.g., AI summaries, search indexing, backups).

We do not claim ownership of your journal entries.

5. Subscription and Billing

Premium features are available on a subscription basis.

Subscriptions renew automatically unless canceled before the billing date.

No refunds are provided for unused subscription periods, except as required by law.

6. Intellectual Property

All trademarks, logos, software, and content (except user-generated content) are the property of DayEcho and protected by copyright and other laws.

7. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We make no warranties regarding accuracy, reliability, or availability.

8. Limitation of Liability

To the maximum extent permitted by law, DayEcho and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services.

9. Termination

We may suspend or terminate your access at any time if you violate these Terms. You may stop using the Services at any time by deleting your account.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Insert Country/State]. Any disputes shall be resolved in the courts of Sweden.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes means you accept the revised Terms.

12. Premium Search Fair Use
Premium users are granted generous access to AI-powered search. To ensure service stability and prevent misuse, a fair use policy applies: searches are limited to 60 queries within any rolling 24-hour window. In addition, a burst limit of 12 queries per 5 minutes applies. Burst tokens are replenished gradually at the rate of 1 query every 25 seconds. These measures are designed to ensure that normal personal use always feels unlimited, while preventing automated or excessive activity that could negatively impact the service for other users.

13. Premium Voice Notes Fair Use
Premium users may record longer and multiple voice notes per day. To maintain fair usage and manage processing costs, a soft limit applies: up to 10 voice notes per day, with each note lasting up to 3 minutes. Normal personal journaling will not be affected by these limits.

14. Premium Image Uploads Fair Use
Premium users may attach multiple photos to journal entries. To prevent abuse or automated uploads, a fair use policy applies: up to 10 photos per entry and a maximum of 30 photos per day (spread over different posts). These limits are designed to accommodate normal journaling while safeguarding the service.
